1. General provisions

These Terms and Conditions (hereinafter: the “Terms”) govern the relationship between the service provider, BDC d.o.o., OIB: 32986581405, with its registered office at Graščica 36, Zagreb, Croatia, operating under the brand “Croatia Outdoor”, e-mail: info@croatiaoutdoor.com, web: www.croatiaoutdoor.com (hereinafter: the “Organizer”), and the users of the Organizer’s services (hereinafter: the “Participant”).www.croatiaoutdoor.com

By accepting these Terms, whether online via the website, by e-mail, message, reservation confirmation, payment for the service or physical signature, the Participant confirms that:

• he/she is familiar with the nature of the activity and the type of service he/she is using;

• he/she understands that outdoor activities, cycling, e-bike tours, hiking tours and similar activities involve increased and unpredictable risks;

• he/she accepts all provisions of these Terms;

• he/she understands that acceptance of these Terms creates an agreement for the use of the service between the Participant and the Organizer.

These Terms are available on the Organizer’s website and, where applicable, in a visible place at the location where equipment is collected and returned. The Organizer recommends that the Participant read these Terms before making a reservation and before using the service.

If an individual service is governed by additional special terms, a tour description, offer, programme, safety instructions, equipment handover record or another document issued by the Organizer, such documents shall form an integral part of the contractual relationship between the Organizer and the Participant.

2. Description of services

The Organizer provides active, recreational and adventure tourism services, including in particular:

• guided e-bike tours;

• rental of electric bicycles and electric mountain bikes for individual or group use;

• guided or individual urban, recreational and mountain/hiking tours;

• team-building programmes and tailor-made group programmes;

• additional content, such as food and drink tastings, visits to landmarks, hospitality services, transport and other content, if expressly stated in the service description or offer.

Activities may take place in natural, rural, urban and traffic environments, including:

• forest, gravel, dirt, asphalt and uneven roads and paths;

• ascents, descents, narrow trails, bends, slippery or demanding surfaces;

• changeable weather conditions;

• possible contact with flora and fauna, including pollen, bugs, insects, animals and other natural factors;

• other users of traffic areas and movement spaces, including pedestrians, cyclists, motor vehicles, working machinery and animals.

Descriptions of routes, difficulty, duration, length, elevation gain and route passability are for information purposes and may vary depending on weather conditions, terrain conditions, the ability of the group, traffic, technical circumstances and other circumstances that the Organizer cannot always influence.

3. Reservation and conclusion of agreement

A reservation is deemed confirmed when the Organizer confirms the date/time in writing or by another customary communication method and/or when the Participant pays an advance payment or the full amount of the service, depending on the terms of the individual service.

Each reservation and each payment made to the Organizer constitutes confirmation that the Participant has read, understood and accepted these Terms, provided that the Terms were available to the Participant before or at the time of reservation in a customary and appropriate manner.

The Organizer reserves the right to:

• refuse a reservation before it is confirmed;

• propose another date/time, route or programme before confirming the reservation;

• refuse or cancel a reserved service before its performance begins if objective reasons exist, in particular safety, weather, technical, organizational reasons or force majeure reasons.

If the Organizer cancels a paid service before it begins for reasons that are not caused by the Participant’s conduct, the Participant shall be offered a new date/time or a refund of the paid amount, at the Participant’s choice, no later than within 14 days, unless a shorter period has been agreed or applies in a particular situation.

4. Prices and payment

Prices are expressed in euros (EUR) and include only what is expressly stated in the service description, offer or the Organizer’s price list.

Additional costs, if not included in the service price, may include in particular:

• costs of food and drinks provided by the Organizer or third parties, in accordance with the agreement, service description or third-party price list;

• costs of transporting equipment or Participants before or after the service to a pre-agreed location;

• costs of intervention, transport, return, rescue or other emergency assistance if the need for such intervention arose due to the conduct, condition, omission or request of the Participant;

• costs of repair, replacement, cleaning, loss or theft of equipment, if the Participant is responsible for them under these Terms.

The Organizer may require:

• payment of an advance payment;

• payment of the full amount in advance;

• a deposit or card pre-authorization as security for the return of equipment, proper payment and possible compensation for damage.

Special group engagements, team-building programmes, non-standard routes and tailor-made services shall be agreed in advance by written communication between the Organizer and the Participant or their authorized representative.

5. Cancellations and changes

Cancellation by the Participant is possible only in writing, by e-mail or through another communication channel previously accepted by the Organizer.

Unless otherwise stated in the description of an individual service, the following rules apply:

• for cancellation more than 48 hours before the start of the service, the Organizer shall provide a full refund of the paid funds;

• for cancellation more than 24 hours but less than 48 hours before the start of the service, the Organizer shall provide a refund of 50% of the paid funds;

• for cancellation less than 24 hours before the start of the service, the Participant is not entitled to a refund of the paid funds, unless the Organizer decides otherwise or mandatory regulations provide otherwise.

A delay of up to 15 minutes by the Participant is treated as use of the service from the beginning of the reserved time slot. A delay of more than 15 minutes at the agreed starting location of the service may be considered a no-show. In the event of delay or no-show, the Participant is not entitled to a refund of the paid funds, unless the Organizer decides otherwise in the specific case.

The Organizer may extraordinarily cancel, postpone, shorten or modify the service due to:

• existing or forecast adverse weather conditions, including storm, heavy rain, thunderstorm, extreme heat, snow, ice or strong wind gusts;

• technical defects in equipment or infrastructure;

• safety reasons;

• insufficient number of participants, if the minimum number of participants was stated in advance in the service description;

• force majeure or other unforeseen circumstances.

If a minimum number of participants is set for a particular tour, that number must be stated in the service description, offer or reservation confirmation. If the minimum number is not reached, the Organizer may cancel the tour and offer the Participant another date/time or a refund of the paid amount.

6. Weather and other conditions

The Participant accepts that activities depend on weather conditions, terrain conditions, route conditions, traffic, technical circumstances, the ability of the group and other circumstances that may change immediately before or during the activity.

The terrain may be wet, slippery, uneven, steep or demanding, and the route may include ascents, descents, narrow trails, gravel, forest roads, public roads and other surfaces of varying levels of difficulty.

Light rain or a short shower during the provision of the service does not automatically constitute a reason for cancellation or interruption of the service. The decision to hold, modify, postpone or interrupt an activity due to weather, safety or other circumstances shall be made by the Organizer or guide, taking into account the forecast, terrain conditions, the ability of the group and the overall safety of carrying out the activity.

Before the start of the service, the Participant is required to inform himself/herself about the nature of the activity, route difficulty, required equipment, weather forecast and his/her own ability to participate safely.

7. Participation, health condition and assumption of risk

By accepting these Terms, the Participant declares that:

• he/she is fully informed about the activity in which he/she is participating or has had the opportunity to request additional information before the activity begins;

• he/she is physically and mentally capable of participating in the activity;

• he/she has the appropriate abilities, experience and level of fitness for cycling, using an e-bike or hiking, depending on the type of service;

• he/she has no health problems, injuries, therapies, allergies or other circumstances that could endanger his/her safety, the safety of other participants or the safe performance of the activity, except for those timely reported to the Organizer;

• he/she participates with awareness of the nature of the activity and the usual risks associated with such activities.

Before the start of the activity, the Participant is required to inform the Organizer of all health conditions, injuries, therapies, allergies, pregnancy, balance difficulties, heart problems, epilepsy or other circumstances that may affect the safety of participation.

The Organizer has the right to refuse participation, propose an easier route, modify the programme or terminate the Participant’s participation if it assesses that continuing the activity would pose an increased risk to the Participant, the group, third parties, equipment or the Organizer.

8. Limitation of the organizer’s liability

The Organizer shall not be liable for damage, injuries, health consequences, losses or other consequences arising from failure to follow the instructions of the Organizer or guide, improper use of equipment, risky behaviour, riding or moving outside the agreed route, incorrect assessment of one’s own abilities, undisclosed health condition, conduct contrary to these Terms, conduct of third parties or circumstances that the Organizer could not foresee, avoid or remedy.

The Organizer shall not be liable for interruptions, difficulties or deviations in the use of navigation tools, GPS signal, mobile applications, internet connection or other digital services, except to the extent that such liability would arise from mandatory regulations.

The foregoing does not exclude the Organizer’s liability in cases where the damage results from its intent, gross negligence, defective equipment provided by the Organizer for use and which the Organizer knew or should have known was unsafe, or another omission for which the Organizer is liable under the applicable regulations of the Republic of Croatia.

9. Safety and conduct of participants

The Participant is obliged to:

• possess the appropriate abilities, skills and experience for cycling or hiking, depending on the type of service;

• in a timely manner, inform himself/herself about the type of service, route difficulty, and technical characteristics of trails, terrain, bicycles and other equipment used;

• follow the instructions of the guide or another authorized person of the Organizer during guided activities;

• take care of his/her own safety, the safety of other persons and the safety of equipment;

• ride and move in accordance with his/her abilities, terrain conditions and traffic rules;

• use protective equipment, whereby wearing a helmet is mandatory when cycling;

• respect nature, the environment, private property, traffic regulations, signs, movement restrictions and special rules of the area in which he/she moves;

• immediately report to the guide or Organizer any accident, injury, defect, loss of equipment or other circumstance relevant to safety.

The Participant is prohibited from:

• using the service, cycling or hiking under the influence of alcohol, narcotics, drugs, medication or other substances that may affect the ability to participate safely;

• risky, irresponsible or aggressive behaviour;

• failing to follow the instructions of the guide or Organizer;

• violating traffic regulations, rules of conduct in protected or other areas, prohibition signs and instructions of competent persons;

• handing over rented equipment to a third person without the prior consent of the Organizer.

The Organizer has the right to immediately exclude the Participant from the activity without refund if the Participant’s conduct endangers himself/herself, other persons, equipment or the performance of the activity, or if, after a warning, the Participant continues to act contrary to these Terms, the Organizer’s instructions or applicable regulations.

In the event of interruption or denial of the service for reasons attributable to the Participant, the Participant is obliged to return all equipment to the agreed location and is not entitled to a refund of the paid funds, unless the Organizer decides otherwise or mandatory regulations provide otherwise.

10. Course of the activity

The Organizer or guide reserves the right to adapt, modify, shorten, extend, postpone or interrupt a tour or other activity in the event of:

• sudden changes in weather conditions;

• safety reasons;

• technical defects or equipment problems;

• injury, exhaustion, illness or insufficient readiness of the Participant or group;

• changes in terrain conditions, traffic, closed paths, works, movement restrictions or other circumstances.

During guided tours, the Participant is required to move in accordance with the pace and instructions of the guide and may not leave the group or route on his/her own initiative without notifying the guide.

11. Technical defects and equipment malfunctions

In the event of an equipment malfunction, the Organizer shall, depending on the circumstances, attempt to remedy the malfunction, provide replacement equipment, adapt the activity, interrupt the activity or offer a proportional refund.

If the defect or malfunction occurs due to regular use and without the Participant’s fault, the Organizer shall offer an appropriate solution, including replacement equipment, another date/time, or a partial or full refund, depending on the specific circumstances and proportionate to the unused part of the service.

If the defect, damage or loss of equipment is the result of improper use, a fall, negligence, failure to follow instructions, riding outside the permitted or agreed route, theft or another reason for which the Participant is responsible, the Participant shall bear the costs of repair, replacement, transport and other related costs.

12. Special rules for rental of bicycles and equipment

When renting bicycles or other equipment, the Participant takes over the equipment in functional condition and undertakes to use it carefully, responsibly and in accordance with the Organizer’s instructions.

Before use begins, the Organizer may perform a basic equipment check and, if necessary, provide the Participant with basic instructions for using the e-bike, including seat adjustment, brake check, use of motor assistance, battery, display, gears and other equipment.

Before departure, the Participant is required to report any observed defect or damage. If the Participant begins using the equipment without objections, the equipment shall be deemed to have been taken over in functional condition, except for hidden defects that could not have been noticed during a customary inspection.

The Participant is liable for all damage, loss or theft of equipment from the moment of taking over the equipment until its proper return, unless he/she proves that the damage was not caused by his/her fault.

The Participant specifically undertakes to:

• not hand over the bicycle or equipment to a third person without the Organizer’s consent;

• not use the bicycle outside the agreed time, area or type of route if such restrictions have been determined;

• lock the bicycle securely when leaving it without direct supervision;

• not remove, modify or damage parts of the bicycle, battery, display, lock, helmet or other equipment;

• immediately notify the Organizer in the event of an accident, fall, defect, theft, loss or damage to equipment.

The amount of compensation for damage shall be determined according to the actual cost of repair, replacement of parts, acquisition of new equipment, transport or according to the Price List for Damage, Loss and Theft of Equipment, if such price list has been published or presented to the Participant before the start of use of the service.

13. Deposit and card pre-authorization

Before the start of rental or another service, the Organizer may request a deposit or pre-authorization of a credit/debit card as security for the return of equipment, payment of the agreed service and possible compensation for damage.

The amount of the deposit or pre-authorization is determined according to the type and value of the equipment, duration of rental, number of participants and other circumstances, and is stated in the price list, offer, reservation confirmation or another notice of the Organizer.

The deposit or pre-authorization shall be released or returned after proper return of the equipment, except in the event of damage, loss, theft, late return, unpaid costs or other claims of the Organizer against the Participant.

If the Organizer retains part or all of the deposit or charges an amount based on the pre-authorization, it shall, at the Participant’s request, provide an explanation and calculation of the costs or damage incurred.

14. Individual use of routes and navigation without a guide

In the case of individual rental without a guide, the Participant independently chooses the pace, manner of movement and adherence to the proposed route, unless expressly agreed otherwise.

Proposed routes, GPX tracks, applications, digital maps, navigation instructions and recommendations of the Organizer are for information purposes and do not replace the Participant’s personal assessment, traffic regulations, signs on the terrain, movement restrictions, special regimes for the use of space and the obligation to act reasonably.

The Participant is required to comply with traffic regulations, private property, forest and other special regimes for the use of space, rules of protected areas, weather conditions and his/her own abilities. If the Participant assesses that the route is unsafe or unsuitable for his/her abilities, he/she is required to adapt his/her movement, return or contact the Organizer.

15. Delay, rental duration and return of equipment

The Participant must arrive at the time set as the start of use of the service. The Organizer is not obliged to wait for a Participant who is late, and the tour or other service may begin without the late Participant.

The Participant is required to comply with the agreed rental time, break time, continuation of the activity and return of equipment. Late return of equipment may result in the charging of additional rental time, organizational costs, transport costs or other actually incurred costs.

In the event of delay, no-show or late return of equipment, the Participant loses the right to a refund of funds for the reservation or use of the service, unless the Organizer decides otherwise or mandatory regulations provide otherwise.

16. Minors and persons with limitations

Participation of minors is permitted only with the prior consent of a parent or guardian, depending on the type of service and the Organizer’s assessment.

Rental of an electric bicycle to a minor without accompaniment by a parent or guardian is not permitted, unless the Organizer expressly determines otherwise for a specific service and all safety conditions are met.

Participation of minors in guided tours is possible only with the prior consent of a parent/guardian and subject to the Organizer’s assessment that the route is suitable for the age, height, experience and psychophysical readiness of the minor. The Organizer may determine a minimum age, height, experience or other participation requirements for a particular route or service.

The parent or guardian who gives consent or accompanies the minor assumes responsibility for the accuracy of the information provided about the minor’s abilities, experience and health condition.

The Organizer has the right to refuse or terminate the provision of the service to persons who have health, physical, psychophysical or other limitations that, according to the Organizer’s reasonable assessment, call into question the safe consumption of the service, the safety of other participants or the safety of equipment.

17. Personal belongings

The Organizer shall not be liable for loss, theft or damage to the Participant’s personal belongings during use of the service, unless the damage occurred due to circumstances for which the Organizer is liable under applicable regulations.

The Participant is required to take care of his/her own personal belongings, documents, money, mobile phones, cameras, glasses, clothing and other items carried with him/her.

18. Accidents, injuries and emergency interventions

In the event of an accident, injury, sudden illness or other emergency situation during a guided activity, the guide or another authorized person of the Organizer shall take reasonable assistance measures in accordance with his/her possibilities, knowledge, equipment and the circumstances, including calling emergency medical services, rescue services, police or another competent service.

If the service does not include a guide, the Participant independently assumes responsibility for timely seeking assistance, contacting emergency services, the Organizer or other persons in the event of an accident, injury, defect, loss of orientation or need to interrupt the service.

The costs of rescue, extraction, transport, medical or other emergency assistance shall be borne by the Participant for whom the assistance was engaged, or by his/her parent/guardian if the Participant is a minor, unless the need for intervention is a consequence of circumstances for which the Organizer is liable under applicable regulations.

19. Photographs, recordings and promotional materials

During activities, the Organizer may take photographs and videos for the purpose of documenting activities, internal records, informing the public and promoting its services, while respecting personal data protection regulations.

Where photographs or recordings are used in such a way that the Participant is clearly recognizable as the main subject of the image/recording, the Organizer shall request the Participant’s separate consent for such publication, unless there is another appropriate legal basis in accordance with personal data protection regulations.

For photographs and recordings of minors, the consent of a parent or guardian is required when such photographs or recordings are used for promotional purposes in such a way that the minor is clearly recognizable.

The Participant may at any time inform the Organizer that he/she does not wish to be photographed or recorded for promotional purposes, and the Organizer shall respect such request to a reasonable extent, taking into account the nature of the activity and previously published materials.

20. Personal data protection

The Organizer processes the Participant’s personal data for the purpose of organizing and carrying out activities, processing reservations and payments, communicating in connection with the service, fulfilling legal obligations, protecting the rights and interests of the Organizer and, if the Participant has given consent, for marketing purposes.

Personal data may include name and surname, contact details, reservation details, payment details, data required for taking over and returning equipment, any information provided by the Participant for participation safety purposes, and other data necessary for providing the service.

Detailed information on the processing of personal data, data subject rights, retention periods, recipients of data and contact for exercising rights is available in the Organizer’s Privacy Policy, published on the Organizer’s website or made available in another appropriate manner.

21. Complaints

The Participant may submit a written complaint regarding the service via the Organizer’s official e-mail address, by post to the Organizer’s registered office address or in person at the Organizer’s business premises, if applicable.

The Organizer shall confirm receipt of the complaint without delay, if possible considering the method of receipt, and shall respond to the complaint in writing no later than within 15 days from the date of receipt.

The Participant is advised to submit the complaint as soon as possible after completion of the service and to state in the complaint his/her details, the date of use of the service, a description of the circumstances and a proposed solution, so that the Organizer can process the complaint in a timely and proper manner.

22. Additional services provided by third parties

Certain additional services, such as hospitality services, tastings, tickets, transport, accommodation, visits to landmarks or other content, may be provided by third parties.

Unless expressly stated otherwise in the offer or service description, the direct provider of the respective service shall be responsible for the performance, quality, availability and safety of services directly provided by third parties, in accordance with its own terms and conditions and applicable regulations.

The Organizer shall endeavor to select reliable partners and providers of additional services, but shall not be liable for omissions of third parties, except to the extent that such liability would arise from applicable regulations or an express contractual relationship with the Participant.

23. Final provisions

The law of the Republic of Croatia shall apply to all relationships not regulated by these Terms.

If any provision of these Terms is found to be null, invalid or unenforceable, this shall not affect the validity of the remaining provisions. Such provision shall be replaced by a valid provision that corresponds, to the greatest possible extent, to the purpose and meaning of the original provision.

The Organizer and the Participant shall endeavor to resolve all possible misunderstandings and disputes amicably. If an amicable solution is not possible, the court with subject-matter jurisdiction under the applicable regulations of the Republic of Croatia shall have jurisdiction to resolve the dispute.

These Terms are published on the Organizer’s website in Croatian and, if necessary, in English, and may be physically available at the location where rental, collection or return of equipment is carried out.

The Organizer may amend these Terms. The Terms that were valid and available to the Participant at the time of reservation confirmation shall apply to an individual reservation, unless it is more favorable for the Participant to apply subsequently amended Terms or unless applicable regulations provide otherwise.

These Terms enter into force on the date of their adoption.
